If you are unable to agree as to the division of your relationship property then your matter can be filed in Court for a decision. The law provides for a 50/50 notional half share but there are exceptions to this rule, such as where “exceptional circumstances may exist.” There are also provisions for the Court to look at circumstances such as where one party has given up their career to take on the role as partner and to raise the children (economic disparity). In these cases the Court have a discretion to compensate for this.
